99025 Whose Line is it Anyway? Determining Property Rights - TRAINING ON DEMAND

There is a strong need for districts to acquire uniform and consistent rights, but the real world often presents gray areas or misunderstandings on what a landowner is willing or able to agree to. There is a significant need for early and accurate information on title and all affected interests, boundaries, mortgages, and pre-existing easements and conditions. Behind some conversations lie assumptions on both sides about the power of eminent domain as an alternative to negotiation. We find that one of the most important keys to success in landowner negotiations is for both sides to work from the same correct information, and we will provide strategies for how to collect, analyze, and discuss the data which should drive a successful and effective easement or right of way negotiation.
